Amends Code of Alabama sections 16-64-2 and 16-64-4 to further define qualifications for resident student status at public institutions of higher education.

Establishes resident tuition eligibility for non-minor students who are full-time permanent employees of the institution, or spouses of such employees, or members of the U.S. military on active duty stationed in Alabama, among other criteria.

Permits governing boards of four-year public institutions to set tuition rates for distance learning programs delivered to students outside Alabama state boundaries.

Authorizes the Chancellor of the Department of Postsecondary Education to set tuition rates for distance learning programs at two-year public institutions for out-of-state students.

Maintains existing requirement that nonresident undergraduate students be charged a minimum tuition of two times the resident tuition rate; becomes effective on the first day of the third month following passage and Governor approval.
