SB450 Summary

• Amends Section 39-2-2 of the Code of Alabama 1975 regarding public works contracts to allow awarding authorities to proceed with contract awards when newspapers fail to publish required bid advertisements.

• Permits an awarding authority to let a public works contract if a newspaper that received an advertisement for sealed bids did not publish the advertisement for one or more weeks, provided the authority can demonstrate proof of submission to the newspaper.

• Applies to contracts exceeding $50,000 where sealed bid advertisements are otherwise required by law, relieving authorities of contract nullification due to newspaper publication failures.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
