SB5 Summary

• Amends Section 11-44G-2 of the Alabama Code to exempt Class 7 and Class 8 municipalities with populations of 12,000 or more inhabitants from the vacancy-filling procedures currently specified in that section.

• Municipalities with 12,000 or more inhabitants shall instead fill mayor vacancies pursuant to Section 11-43-42(a), which provides that the city council president shall succeed the mayor in case of a vacancy.

• Maintains existing procedures for Class 7 and Class 8 municipalities with populations below 12,000, including city council appointment procedures, gubernatorial appointment options, and special election requirements if vacancies are not filled within specified timeframes.

• Preserves voter identification requirements for any elections held to fill vacancies, accepting forms such as driver's licenses, birth certificates, passports, and government-issued identification.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
