SB98 Summary

• Amends Section 24-1-28 of the Code of Alabama 1975 to require municipal public housing authorities to obtain municipal council approval before exercising the power of eminent domain.

• Municipal public housing authorities in Class 3 municipalities (except those organized under Act 618 of the 1973 Regular Session) must obtain governing body approval to exercise eminent domain powers.

• Requires authorities to publish notice of intent to purchase property in a newspaper of general circulation for three consecutive weeks prior to executing any binding purchase agreement.

• Prohibits acquisition of property belonging to any city within the authority's boundaries, government entities, or public utility corporations without their respective consent or regulatory approval.

• Act becomes effective on the first day of the third month following passage and approval by the Governor.
