HB17 Summary

• State officers, employees, and agents acting in their official capacity are immune from liability in any suit pursuant to Article I, Section 14 of the Alabama Constitution of 1901.

• State officers, employees, and agents are not personally liable for acts within the scope of their duties that involve the exercise of judgment or discretion, unless they act willfully, maliciously, fraudulently, in bad faith, or beyond their authority.

• Employees of the State Board of Education and local boards of education receive the same official capacity immunity and personal liability protections as other state employees under the same exceptions.

• The act becomes effective immediately upon passage and approval by the Governor or upon otherwise becoming law.
