HB172 Summary

• Authorizes the Municipal Court of the City of Pelham in Shelby County to assess a prisoner transport fee against defendants for expenses incurred transporting them from another municipal jail, county jail, or state detention facility to Pelham's municipal jail on misdemeanor warrants.

• Fee may only be assessed when a defendant is adjudicated guilty or pleads guilty, and only applies to transport from outside Pelham's police jurisdiction but within Alabama.

• Transport fees are determined by distance traveled with the following schedule: less than 39 miles ($100), 40-99 miles ($200), 100-200 miles ($250), and greater than 200 miles ($300).

• All fees collected shall be deposited into the City of Pelham General Fund and allocated in conformity with Section 11-47-7.1 of the Code of Alabama 1975.

• Act becomes effective immediately upon passage and approval by the Governor; House passed February 13, 2014, and Senate passed March 18, 2014.
