HB205 Summary

• Amends Section 12-19-43 of the Alabama Code to allow probate court fees to be collected at the court's discretion either when a pleading is filed or at the termination of the suit, changing from the previous requirement that fees be due only at suit termination.

• Permits probate judges to order security deposits to be deposited into probate court in cases where appropriate to cover expected court costs.

• Requires that any unused security deposits be returned to the person who paid them.

• Maintains existing requirements that fees for transcripts and copies must be due when the service is performed and that no fee except for final record can be demanded unless the service has been completed.

• Takes effect on the first day of the third month following passage and approval by the Governor.
