HB213 Summary

• Renames the offense of "fraudulent repair of an airbag" to "airbag fraud" and expands the definition to include manufacturing, importing, selling, offering for sale, installing, or reinstalling counterfeit, nonfunctional, or defective airbags.

• Creates criminal penalties for selling, installing, or reinstalling devices that cause a vehicle's diagnostic system to falsely indicate the presence of a functional airbag, and for selling vehicles with counterfeit, nonfunctional, or missing airbags with intent to deceive purchasers.

• Establishes airbag fraud as a Class A misdemeanor, with enhanced penalties increasing to a Class C felony if the fraud causes physical injury to a person.

• Repeals Section 13A-11-271 relating to fraudulent sale of motor vehicles without airbags, consolidating airbag-related offenses under the new expanded statute.

• Takes effect on the first day of the third month following passage and approval by the Governor.
