HB27 Summary

• Amends Section 13A-7-6 of the Code of Alabama 1975 to remove the requirement that a dwelling-house be lawfully occupied for burglary in the second degree to occur.

• Expands burglary in the second degree to include unlawful entry into either a lawfully occupied or unoccupied habitable dwelling-house with intent to commit theft or a felony.

• Maintains burglary in the second degree as a Class B felony.

• Becomes effective on the first day of the third month following passage and approval by the Governor, or when otherwise becoming law.

• Exempts the bill from Amendment 621 constitutional requirements regarding new or increased local expenditures because it defines a new crime or amends an existing crime definition.
