Active and contributing members of the Employees' Retirement System of Alabama may purchase up to two years of service credit for time spent receiving workers' compensation benefits under Alabama law due to work-related injuries.

Members are eligible only if they returned to work with their covered employer within one year following the end of workers' compensation benefits.

Members must pay the full actuarially required cost for each year of service credit purchased within two years from the end of the disability period for which credit is sought.

The Board of Control of the Employees' Retirement System shall adopt rules and regulations for administering this provision, including verification of service credit being purchased.

Members cannot receive credit for any period already credited in the retirement system or any other retirement plan, except Social Security.

The act becomes effective on the first day of the third month following passage and approval by the Governor.
