HB325 Summary

• Amends Alabama Code Sections 8-6-18, 13A-8-2, and 15-3-1 to increase the statute of limitations for certain felonies from 3 years to 5 years after the commission of the offense.

• For securities violations and theft by deception prosecutions, the statute of limitations does not commence or begin to accrue until discovery of the facts constituting the deception, after which prosecution must be commenced within 5 years.

• Applies to violations under the securities article involving deception and to theft of property obtained by deception.

• Exemptions to the extended 5-year limitation apply to felonies specified in Sections 15-3-3 and 15-3-5 or any other felony with a separately specified limitations period.

• Effective on the first day of the third month following passage and approval by the Governor.
