HB33 Summary

• Authorizes law enforcement officers to arrest persons without a warrant when they have reasonable cause to believe the person has committed trespass on the premises of an educational institution.

• Expands the definition of "building" under Alabama Code Section 13A-7-1 to include any structure used for any purpose by an educational institution.

• Defines "educational institution" as any public or private college, university, graduate school, professional school, junior college, trade school, elementary school, secondary school, or institution for education and training of the deaf, blind, or individuals with developmental disabilities.

• Adds a new warrantless arrest provision as Section 15-10-3(a)(9) allowing arrest based on reasonable cause for educational institution trespass, similar to existing provisions for felonies and domestic violence.

• Becomes effective immediately upon passage and approval by the Governor.
