HB395 Summary

• Amends Section 30-2-55, Code of Alabama 1975, to add a five-year limit on alimony payments or the length of the marriage, whichever is greater.

• Retains existing law allowing termination of alimony upon proof that the recipient has remarried or is living openly or cohabiting with a member of the opposite sex.

• Applies the remarriage/cohabitation termination provision to all divorce decrees granted before or after April 28, 1978.

• Specifies that no previously received alimony payments must be reimbursed if alimony is later terminated.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
