HB399 Summary

• Amends Section 36-27-8.2 of the Alabama Code to create an exemption from employment restrictions for retired law enforcement officers certified by the Alabama Peace Officers Standards and Training Commission.

• Removes the requirement that retired officers limit compensation to $17,000 annually (adjusted for inflation) and prohibits them from working in permanent full-time positions.

• Qualified retired law enforcement officers must have been certified for 20 or more years, separated from service for at least 12 months, and cannot be reemployed by the same agency in the same position previously held.

• Requires the rehiring agency to remit a surcharge equal to the employer contribution for an active member and the retired officer must contribute 8.5% of earnable compensation to the retirement system; no additional retirement credit is earned.

• Becomes effective immediately upon passage and approval by the Governor.
