HB 475 Summary

• Authorizes all counties and municipalities designated under EPA's municipal separate storm sewer system (MS4) program to carry out storm water management requirements and establish optional intercooperative public corporations for compliance.

• Limits jurisdictional scope of local storm water programs to only sites discharging into municipal separate storm sewer systems and limits substantive scope to rules absolutely required by the Clean Water Act.

• Exempts discharges from Alabama Public Service Commission-regulated entities and establishes fee limits: $10 maximum annual flat fee for residential properties, $0.0005 per square foot (capped at $3,000) for commercial properties, and prohibits fees on greenfields and agricultural land.

• Requires ADEM to maintain primary permitting and enforcement responsibility for NPDES sites and directs local programs to primarily rely on ADEM to avoid double regulation.

• Requires ADEM to revise regulations within 365 days and governing bodies to comply within 90 days after ADEM fulfills its obligations.
