HB 519 Summary

• Amends Sections 31-12-5 and 31-12-6 of the Code of Alabama 1975 to extend salary differential protections to state employees, public education employees, and local government employees called into active service in the Armed Forces of the United States.

• Makes salary differential payments mandatory for state employees and public education employees (previously mandatory only for state employees during the war on terrorism that commenced in September 2001), and allows local governmental entities to provide discretionary salary differentials.

• Salary differential equals the difference between the employee's higher public salary and their lower active duty military base pay, paid for the length of time set forth in the Uniformed Services Employment Rights Act, 38 U.S.C. § 4312(c).

• Changes the scope of eligibility from employees called into active service only "during the war on terrorism which commenced in September 2001" to any active service in the Armed Forces of the United States.

• Becomes effective immediately upon passage and approval by the Governor.
