HB78 Summary

• Amends Section 11-52-31 of the Code of Alabama 1975 to authorize municipal planning commissions to adopt regulations allowing administrative approval of minor subdivisions without a public hearing.

• Defines a minor subdivision as the subdivision of land into not more than 6 lots or a reduction of the number of lots in an existing subdivision.

• Requires that developers of approved minor subdivisions shall not require any public improvements, dedication of public ways, or expenditure of public funds.

• Mandates that minor subdivision plans must not conflict with the master plan, official zoning map, zoning ordinances, or other subdivision regulations.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
