HB92 Summary

• Amends Alabama Code Section 45-26-81.22 to authorize the Elmore County judge of probate to establish policies governing sale of or access to computerized index information and digitized images maintained by the probate office.

• Requires a special recording fee of $3 to be collected on each real or personal property, Uniform Commercial Code, judicial, or other instrument recorded or filed in Elmore County, in addition to all other required fees and charges.

• Permits the judge of probate to retain court records using optical disks or other computerized storage methods and to discontinue use of microfilm, with digitized records constituting official records that may be sold to the public.

• Directs all funds received from the sale of computerized index information and digitized images to the county general fund for acquiring and maintaining archival equipment, improving office operations, supplementing salaries, and acquiring office space at the judge's discretion.

• Becomes effective on the first day of the third month following passage and Governor approval.
