HB96 Summary

• Amends Section 2-8-193 of the Alabama Code to authorize cotton producer commissions to conduct referendums on assessments without any provision for refunds, in addition to existing refund-permitted assessments.

• New assessments approved under the non-refund referendum option shall supersede any prior assessments being collected at the time of the referendum.

• Repeals Section 2-8-203 of the Alabama Code, which provided the mechanism for cotton producer refunds of assessments.

• The act becomes effective only upon adoption of a constitutional amendment deleting the refund requirement for cotton producer assessments from Amendment 388 of the Alabama Constitution of 1901.
