SB113 Summary

• Amends Alabama Code Section 12-19-290 to allow circuit and district court clerks to accept credit cards, charge cards, and debit cards for payment of court costs, fees, fines, forfeitures, and assessments, subject to adoption of uniform rules by the Administrative Office of Courts.

• Excludes judgments, restitution, attorney fees, and monies payable to individuals, businesses, or partnerships (other than governmental agencies) from credit card payment authorization.

• Authorizes court clerks to impose and collect surcharges or convenience fees not exceeding the sum of: (a) the transaction fee charged by the card issuer/processor, and (b) any costs charged by contracting entities providing software and management services.

• Ratifies and confirms any surcharges or convenience fees previously charged and collected by court clerks prior to the act's effective date.

• Designates all fee revenue from state courts to the Advanced Technology and Data Exchange Fund and municipal court fees to the municipality's general fund.
