SB123 Summary

• Amends Section 27-52-1 of the Alabama Code to authorize the Alabama Health Insurance Plan (a high-risk pool) to cease operations if a federal mandate includes market reform provisions satisfying the guaranteed-issue requirements of HIPAA.

• Requires the Alabama Health Insurance Plan to provide current participants with sufficient time to transition out of the plan before cessation of operations.

• Directs transfer of any unspent and unencumbered funds remaining after all plan liabilities are satisfied to the State General Fund.

• Mandates reestablishment and implementation of the Alabama Health Insurance Plan if federal law requires Alabama to offer guaranteed-issue health coverage to eligible individuals after the effective date of this act.

• Becomes effective immediately upon passage and gubernatorial approval.
