SB13 Summary

• Establishes the Alabama Behavior Analyst Licensing Board within the Division of Developmental Disabilities of the Department of Mental Health to regulate behavior analyst professionals.

• Creates two licensure categories: Licensed Behavior Analyst (requires board certification as behavior analyst) and Licensed Assistant Behavior Analyst (requires board certification and ongoing supervision by a licensed behavior analyst).

• Board consists of 7 members appointed by the Governor: 4 licensed behavior analysts, 1 licensed psychologist, 1 parent/guardian or service recipient, and 1 public member; members serve 3-year staggered terms with a maximum of two successive terms.

• Prohibits unlicensed practice of behavior analysis with exemptions for psychologists, physicians, graduate students in approved programs, and other licensed professionals acting within their scope of practice.

• Violations punishable by fine up to $1,000 or suspension/revocation of license; board automatically terminates October 1, 2016, and every four years thereafter unless legislation continues it.
