SB178 Summary

• Increases notice requirement for proposed rules from 35 days to 60 days before agencies can adopt, amend, or repeal rules under the Administrative Procedure Act.

• Changes the effective date of rules from 35 days after filing with the Legislative Reference Service to upon adjournment of the next legislative session following the appeal process, if the Legislature fails to disapprove after Lieutenant Governor approval.

• Adds a new appeal mechanism allowing disapprovals of rules by the Legislative Council to be appealed to the Lieutenant Governor, who may review and hold public hearings before approving or sustaining the disapproval.

• If the Lieutenant Governor approves a rule, it becomes effective upon adjournment of the next regular legislative session unless the Legislature adopts a joint resolution overruling the approval.

• Effective date contingent on the effective date of SB11 of the 2014 Regular Session.
