SB193 Summary

• Amends Alabama Code Sections 13A-5-40 and 13A-5-49 to add prosecutors to the definition of law enforcement officers for purposes of capital offense statutes.

• Establishes murder of a prosecutor as an enumerated capital offense.

• Creates new capital offenses including: murder on a school campus; murder in a day care or licensed child care facility; murder of a victim under a Protection From Abuse Order; and murder of a family member of law enforcement or public officials to avenge, intimidate, or retaliate.

• Adds murder of a victim, juror, or family member to avenge, intimidate, or retaliate as enumerated capital offenses.

• Creates new aggravating capital factor for intentional killing of a law enforcement officer while in the line of duty; effective the first day of the third month following passage and approval.
