SB199 Summary

• Legislature must adopt a joint resolution with instructions for delegates and alternate delegates to an Article V Convention at the time of their appointment, addressing rules of procedure and any other matters the Legislature deems necessary.

• Any vote cast by a delegate or alternate delegate outside the scope of legislative instructions or limits on subjects for consideration is void, and the delegate forfeits their appointment upon such a vote or attempted vote.

• A delegate or alternate delegate who knowingly or intentionally votes or attempts to vote outside the scope of instructions commits a Class A misdemeanor, prosecutable by the Attorney General or Montgomery County district attorney.

• If all delegates and alternate delegates vote or attempt to vote outside the scope of instructions, Alabama's application to call an Article V Convention ceases to be a continuing application and has no effect.

• The act becomes effective on the first day of the third month following passage and gubernatorial approval.
