SB2 Summary

• Amends Alabama Code Section 13A-5-40 to add murder in violation of a protection order as a capital offense, known as "Kelley's Law."

• Makes it a capital offense when a court has issued a protective order under Section 30-5-1 et seq. on behalf of the victim against the defendant, or the protective order was issued as a condition of the defendant's pretrial release.

• Bill is excluded from Amendment 621 requirements because it defines a new crime rather than requiring new local expenditures.

• Becomes effective on the first day of the third month following passage and approval by the Governor.

• Senate passed 18-FEB-14; House passed 02-APR-14.
