Court clerks in circuit and district courts shall retain 5% of each docket fee collected as an administrative collection fee to be distributed to the State Judicial Administration Fund.

The 5% administrative fee is retained by the court clerk before distribution to other agencies or entities and does not impose additional charges on civil litigants or criminal defendants.

The 5% fee shall not apply to docket fees collected in juvenile cases, child support cases, or fees distributed to the State General Fund, State Judicial Administration Fund, Presiding Circuit Judge's Judicial Administration Fund, or Circuit Clerk's Judicial Administration Fund.

The 5% fee shall not apply to any other docket fee mandated to be collected and distributed for use by any court, the Administrative Office of Courts, or the Unified Judicial System.

The Administrative Office of Courts may promulgate rules necessary to administer this section, and the act becomes effective immediately upon passage and approval by the Governor.
