SB21 Summary

• Amends Section 23-1-60 of the Code of Alabama 1975 to grant the Director of Transportation authority to alter plans, character of work, and construction details during highway projects without competitive bidding.

• Authorizes the Director to determine the need for extra work not originally contemplated in construction contracts, limited to work within the original project termini except as necessary for feasible and economical completion.

• Permits the Director to enter supplemental contracts with prime contractors for extra work at agreed unit prices or lump sums, or authorize work on a force account basis if pricing cannot be agreed upon.

• Allows the Director to authorize additional work, changes, alterations, or requirements up to $100,000 or 10 percent of the initial contract amount (whichever is greater) without Governor approval, provided aggregate increases do not exceed $200,000.

• Permits the Director to authorize contract decreases or underruns without Governor approval, and requires the Department of Transportation to develop implementation procedures.
