SB274 Summary

• Repeals Amendments 425 and 555 to the Alabama Constitution of 1901 relating to local constitutional amendments and replaces them with new procedures in Section 284.01.

• Legislature must determine whether a proposed constitutional amendment affects only one county or a political subdivision within one or more counties using a three-fifths vote in each house.

• Local amendments require approval by a majority of qualified electors in the affected county or political subdivision and county/counties where it is located; if any dissenting vote occurs on local designation, the amendment automatically goes to statewide referendum.

• Statewide amendments require approval by a majority of qualified voters statewide and a majority in any county or political subdivision named in the resolution.

• Election notice must be published once weekly for four successive weeks in newspapers qualified to run legal notices in affected county or counties, with election held per existing constitutional procedures.
