SB338 Summary

• Prohibits dump trucks from operating on any highway, road, or municipal street in Alabama with the truck bed raised more than a 20-degree angle, except when actively dumping a load.

• Defines a dump truck as a motor vehicle with a bed that raises near the passenger compartment to over 20 degrees to allow loads to be dumped from the rear.

• First offense is a Class C misdemeanor; second or subsequent offenses are Class B misdemeanors.

• Authorizes any law enforcement officer to enforce the provision and issue citations at accident scenes if the officer has reasonable cause to believe a violation occurred, even without witnessing it.

• Becomes effective on the first day of the third month following passage and gubernatorial approval; known as "The Ricky Morgan Act."
