SB349 Summary

• Allows persons to enter into valid and enforceable contracts to purchase or sell lots in proposed subdivisions prior to plat approval, reversing a court ruling that deemed such pre-approval contracts void.

• Requires subdivision plat approval by county or municipal planning commission and recording in the probate office before any lot can be conveyed to a third party.

• Prohibits counties and municipalities from adopting rules, regulations, or ordinances that would impair or prohibit offering for sale, leasing, or negotiating contracts for lots within proposed subdivisions prior to approval.

• Makes consistent the definitions and procedural provisions for subdivisions across county and municipal subdivision regulations in Sections 11-19-1, 11-24-1, 11-24-2, 11-24-3, and 11-52-1.

• Becomes effective immediately upon passage and approval by the Governor; does not validate contracts entered prior to the effective date.
