SB359 Summary

• Changes the Attorney General's Litigation Support Fund from permissive ("may") to mandatory ("shall") deposits of court-ordered attorney fees, negotiated settlements, and penalties received from litigation.

• Removes previous limitations that capped deposits at 50 percent of the Attorney General's State General Fund allocation and eliminated the 125 percent carryover provision to the next fiscal year.

• Requires the Attorney General to certify all deposits to the Senate Finance and Taxation General Fund Committee, House Ways and Means General Fund Committee, Legislative Fiscal Officer, and state Budget Officer, with detailed descriptions of each deposit.

• Maintains exceptions for attorney fees and penalties related to the 2010 Gulf oil spill, which must be remitted to the State General Fund if received in excess of specified amounts.

• Becomes effective immediately upon passage and approval by the Governor or upon becoming law.
