SB377 Summary

• Licensed distillers in areas where distilled spirits sales are legal may sell souvenir bottles of their manufactured or bottled spirits to visitors, limited to one bottle per brand per visit.

• Distillers may not sell more than 50,000 gallons of distilled spirits annually under the souvenir bottle provision.

• All souvenir bottles must be in unopened packages, comply with ABC Board container size rules, and be labeled or designed differently than containers sold to wholesalers.

• Licensed distillers may ship souvenir bottles to out-of-state consumers only, provided the shipment originates outside Alabama and consumers are not located within the state.

• Sellers are prohibited from selling souvenir bottles to minors or obviously intoxicated persons; all sales must comply with existing ABC Board licensing and enforcement laws.
