SB 391 Summary

• Creates a new Class A felony offense of "aggravated theft of property" for theft exceeding $100,000 in value or theft exceeding $50,000 of public money or revenue from state, county, or municipal government.

• Maintains existing "theft of property in the first degree" as a Class B felony for theft exceeding $2,500 in value or property taken from another person's body.

• Establishes a 6-year statute of limitations for prosecution of aggravated theft of property, compared to the standard 3-year limit for most felonies.

• Excludes offenses involving theft or conversion of securities from the 3-year statute of limitations, applying the 6-year period instead.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
