SB 395 Summary

• Amends Alabama Code Section 3-8-1 to prohibit ownership, possession, maintenance, sale, or trade of nonhuman primates without a USDA or FDA licensed rabies vaccine available.

• Allows current owners to keep existing animals for the animal's lifetime if the animal is spayed or neutered and registered with the Department of Agriculture and Industries.

• Exempts zoological parks, circuses, colleges, universities, approved animal refuges, county or municipal humane shelters, the Department of Conservation and Natural Resources, and veterinary clinics from the prohibition.

• Authorizes seizure of any nonhuman primate lacking the required vaccine or lacking required registration, with disposition ordered by circuit court.

• Establishes violation as a Class C misdemeanor; becomes effective on the first day of the third month following passage and gubernatorial approval.
