SB439 Summary

• Amends Section 28-3A-6 of the Alabama Code to allow alcoholic beverage manufacturers producing over 25,000 barrels annually to operate a restaurant on or adjacent to their licensed manufacturing premises.

• Permits qualifying manufacturers to obtain an additional license to sell and dispense alcoholic beverages at retail for on-premises consumption at the restaurant or food service facility.

• Allows qualifying manufacturers to purchase their own manufactured beverages from licensed wholesalers for retail sale for off-premises consumption.

• Requires manufacturers operating restaurants to comply with existing tax obligations, including filing returns and collecting privilege and excise taxes on beer, table wine, and liquor as if they were wholesalers.

• Effective date is the first day of the third month following passage and approval by the Governor.
