SB453 Summary

• Amends Section 12-17-225.4 of the Alabama Code to change how court-ordered restitution collections are distributed after transfer to the district attorney for collection purposes.

• Reduces the district attorney's share from 75% of the collection fee to 17.31% of the total amount collected, and reduces the circuit clerk's share from 25% of the collection fee to 5.77% of the total amount collected.

• Prioritizes victims by requiring the pro-rata portion of restitution originally ordered by the sentencing court be distributed to victims before any other distributions are made from collected funds.

• Requires remaining collected fees, fines, penalties, charges, court costs, and bail bond forfeitures to be disbursed pro rata on a monthly basis, even if collection is partial.

• Becomes effective on the first day of the third month following passage and approval by the Governor, or its otherwise becoming law.
