The City Councils of Millbrook and Wetumpka in Elmore County may each authorize the sale and distribution of draft beer by retail licensees of the Alcoholic Beverage Control Board within their corporate limits through resolution or ordinance.

Keg beer may not be sold for off-premises consumption in either city.

Draft beer sales cannot be authorized for Alcoholic Beverage Control Board licensees who offer, allow, or conduct gambling as defined in Section 13A-12-20, Code of Alabama 1975.

Draft beer sales cannot be authorized for licensees who offer, allow, or conduct Class II or Class III gaming as defined in 25 U.S.C. §2703.

The act becomes effective immediately upon passage and approval by the Governor or upon otherwise becoming law.
