SB55 Summary

• Establishes statutory immunity for state officers, employees, and agents acting in their official capacity pursuant to Article I, Section 14 of the Alabama Constitution of 1901.

• Provides personal liability protection for state employees performing discretionary duties within the scope of their employment, except when acting willfully, maliciously, fraudulently, in bad faith, or beyond their authority.

• Extends the same immunity protections to "education employees," defined as certified or noncertified employees of the State Board of Education, local boards of education, the Alabama Institute for Deaf and Blind, and the Alabama School of Mathematics and Science.

• Specifies that the act does not eliminate, alter, or modify any other existing immunity protections established under Alabama's constitution and state laws.

• Takes effect immediately upon passage and approval by the Governor or upon becoming law through other means.
