• Urges Alabama Governor and Department of Environmental Management Director to petition the U.S. Environmental Protection Agency to request that Mississippi Department of Environmental Quality (MDEQ) reopen the public comment period and hold a public hearing for Mississippi Silicon, LLC smelting plant permit (No. 2640-0006) issued November 27, 2013.

• Alleges the MDEQ permit is defective because the public comment period was inadequately noticed, no public hearing was held as required by federal law, and Alabama was not provided adequate written notice of potential impacts to Lauderdale, Colbert, and Franklin Counties.

• Claims the permit fails to set appropriate limits for the facility, is based on improperly estimated air emissions, lacks adequate assessment of National Ambient Air Quality Standards compliance, and was issued without requiring adequate technical analyses and air quality modeling.

• Requests EPA issue an order under 42 U.S.C. §7477 to prevent continued construction of the facility until MDEQ revokes the permit and fully complies with Clean Air Act requirements.

• Urges Forest Service Region 8 Supervisor to reevaluate Class I Air Quality Related Values analyses submitted by Mississippi Silicon, LLC due to proximity to Sipsey Wilderness Area within Bankhead National Forest in Alabama.
