HB125 Summary

• Applies exclusively to the Town of Oak Grove in Talladega County and authorizes Sunday sales of alcoholic beverages after 1:00 p.m. by properly licensed retail licensees of the Alcoholic Beverage Control Board.

• City council may permit Sunday alcoholic beverage sales and consumption only after approval by public referendum, and may regulate which retailers participate, whether sales are for off-premises consumption, and other aspects of Sunday sales.

• City must hold a referendum at the next regular election or a special election called for that purpose, with costs paid by the city, and a majority vote in favor is required to authorize Sunday sales.

• A second or subsequent referendum cannot be held within 12 months following a failed referendum.

• The act becomes effective immediately upon passage and approval by the Governor or upon otherwise becoming law.
