HB137 Summary

• Authorizes the City of Bay Minette in Baldwin County to hold a referendum within one year to determine voter approval for Sunday sales of alcoholic beverages for on-premises consumption by licensed retail establishments.

• Requires the city governing body to call the election by resolution and provide voters with a ballot question asking whether they favor legal sale and distribution of alcoholic beverages on Sunday.

• Election shall follow standard municipal election procedures with costs paid from the municipality's general fund, and at least three weeks' notice must be given to qualified voters.

• If a majority votes "Yes," properly licensed retailers may legally sell alcoholic beverages on Sunday for on-premises consumption in compliance with applicable laws; the municipality may enact ordinances to regulate Sunday alcohol sales.

• If a majority votes "No," Sunday sales remain prohibited unless subsequently authorized by law or a future election approving Sunday sales.

• Act becomes effective October 1, 2015.
