Amends Section 12-19-43 of the Alabama Code to allow probate court fees to be collected at the court's discretion either when a pleading is filed or at the termination of suit, changing from the current requirement that fees be due only at suit termination.

Maintains existing rule that fees for transcripts and papers must be paid when the service is performed.

Authorizes probate courts to order security deposits be paid into court to cover expected court costs in appropriate cases.

Requires unused security deposits to be returned to the person who made the deposit.

Effective date is the first day of the third month following passage and approval by the Governor.
