HB210 Summary

• Increases the effective date of agency rules from 35 days to 45 days after filing with the Legislative Reference Service, providing the Joint Committee on Administrative Regulation Review additional time for review.

• Establishes "The Red Tape Reduction Act" requiring agencies to post proposed rules on websites, electronically notify registered persons, and prepare Business Economic Impact Statements when businesses report negative impacts.

• Creates an appeal process allowing agencies to appeal committee disapproval of rules to the Lieutenant Governor, who has 15 days to review and may approve rules that become effective upon adjournment of the next legislative session unless the Legislature overrides by joint resolution.

• Requires agencies to fulfill license and permit requests within 28 calendar days after receiving the application or notify applicants of the reason for denial.

• Repeals Section 41-22-24 and becomes effective October 1, 2015.
