HB275 Summary

• Authorizes awarding authorities to use construction manager/general contractor (CM/GC) and design-build methods as alternatives to the traditional design-bid-build method for public works projects exceeding $15 million in construction costs.

• Excludes all contracts by the Department of Transportation and county or municipal contracts for road or highway construction/maintenance from using CM/GC or design-build methods.

• Specifies that CM/GC and design-builder contractors assume all risk for construction at a contracted price and establishes selection processes requiring prequalification and competitive proposals based on qualifications rather than lowest price alone.

• Provides that prior experience as a CM/GC or design-builder on public projects shall not be a prerequisite for qualification to submit proposals on these alternative delivery methods.

• Establishes penalties of Class C felony for willful violations and allows unsuccessful bidders/proposers and interested citizens to seek injunctive relief within 45 days of contract award; effective October 1, 2016.
