HB28 Summary

• Amends Alabama Code Section 13A-7-22 to enhance penalties for criminal mischief in the second degree involving churches or other religious buildings or property within them.

• Establishes mandatory minimum jail sentences of not less than 10 days for a second conviction within a five-year period and not less than 30 days for a third or subsequent conviction within a five-year period.

• Requires courts to order restitution as a first priority before payment of fines, court costs, or other court-ordered payments in criminal mischief cases involving religious buildings or their property.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
