HB 314 Summary

• Amends Section 35-8B-1 of the Alabama Code to establish provisions for alcoholic beverage sales in community development districts that are annexed by municipalities or incorporated as municipalities.

• Requires that when a municipality annexes a community development district or a district incorporates as a municipality, the territory of the community development district remains wet and authorized to sell alcoholic beverages.

• Allows the remaining portion of an annexing or incorporating municipality to become wet at the discretion of the municipal governing body, rather than being restricted by the county's wet or dry status.

• Adds a new definition of community development district for lakeside residential areas on navigable waters at least 10 miles long situated between man-made dams with at least 50 miles of shoreline, at least 100 private homes, and bordering both a wet county and dry county with wet municipalities.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
