HB47 Summary

• Allows minors under 18 to receive and possess pistols under specific conditions including hunter education, firearms safety courses, target shooting, organized competitions, hunting/fishing with proper licenses, on family property, in armed services, or traveling to these activities.

• Permits employees to possess lawfully-owned firearms and ammunition in privately-owned vehicles parked in public or private parking areas at secure buildings where firearms are otherwise prohibited, provided employee complies with storage requirements.

• Establishes procedure for persons found insane, mentally incompetent, or not guilty by reason of mental disease or defect to petition district court for removal of firearm prohibitions based on preponderance of evidence regarding mental capacity and public safety risk.

• Requires mental health commitment orders involving firearm risk to be forwarded to Alabama Law Enforcement Agency for entry into National Instant Criminal Background Check System (NICS) within specified timeframe.

• Mandates permanent removal and destruction of firearm sales records maintained by dealers, police, sheriffs, or Secretary of State within 180 days of effective date, except records necessary for active investigations or ongoing prosecutions.
