AL HB549

Establishes a $30 booking and administration fee assessed as court costs against defendants booked or incarcerated in Shelby County Jail who are convicted or plead guilty in circuit court, district court, or municipal court in Shelby County.

Fee applies even when the court suspends imposition of sentence or places defendant on probation without entering a judgment of conviction.

Fee is collected by the court clerk or municipal official in the same manner and at the same time as other court costs, and cannot be waived unless all other fees, assessments, costs, fines, and charges are also waived.

Monthly collections of the fee are remitted to the Shelby County Commission and deposited in a special fund within the county general fund designated for jail capital projects and jail maintenance costs.

Effective on the first day of the third month following passage and approval by the Governor.
