HB6 Summary

• Amends Section 11-44G-2 of the Code of Alabama 1975 regarding mayoral vacancy procedures in Class 7 and Class 8 municipalities.

• Exempts municipalities with 12,000 or more inhabitants from the standard vacancy-filling procedures, allowing them instead to fill vacancies pursuant to Section 11-43-42(a), which provides that the council president shall succeed the mayor.

• Maintains existing procedures for smaller Class 7 and Class 8 municipalities, including city council selection of replacements, gubernatorial appointment process, and special election provisions if vacancy is unfilled within specified timeframes.

• Does not apply to cities operating under commission form of government.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
